In many states, child support is based upon the combined incomes of the parents. This is not the case in Texas. Clients should know that in our state, the amount of child support to be paid is determined solely on the income of the parent who does not have primary custody. Custody duration is completely unrelated to child support and the amount which must be paid. Even if a parent has actual physical custody of the children 49% of the time, they would still have to pay the full support amount.
